Hey again

Well - here is a little update on the case. I have decided that i will follow up on the case until the day I die :o)

In the spring this year I had an attorney treadning him, that we would file suit against him. That made him pay some of the money (USD 2000 in travelers cheques and 5200 in money orders) - he stíll owes me 1800 USD

Before I delivered the money orders and cheques I took a copy and sent to Cape Coral Police dept. and my attorney.

And now guess what. At first my bank accepted the money orders and cheques, but today I have had the cheques back; they were fake ( made on a color printer).

So now the case are getting even more complexed. American Express (Bank of America) now wants to start one further investigation.

Since the bank has got involved the police has gotten interested in the case - good for me :o)

We havent found out if there are any fraud involved in the money orders. They comes from different scources, and my bank told me that they have been passing the expiery date, so they need to be "signed over" (dont know what this means)

It has taken long time to clear the cheques and money orders - in that time my attorney and police havent worked on the case. But now after the case also involves cheque-fraud against me and Bank of America, the case is fully active again. I have been speaking to detective Shell at Cape Coral Police dept. a couple of time the last week and we have a very good case now. I may not get my Harley or money right now, but I hope Eduardo will learn.

Its really sad that you have gone thru this problem..
I would at this point get someone that is close to Cape Coral to give you a hand.. I am in Miami so that is quite a bit away from me or else i would help in some way possible.

I think you should contact Marilyn Millian from the Peoples Court and see if you can get on that Court show.. they would fly this heathen there to NYC .. You would definitely win the case because that judge is fair and she is very blatantly direct.

An email is not the same. You have to make a written statement with your signature on it. You often have to be present as well. I'm not sure how Florida law works, but here you have to be in person and sign your name before they will investigate on your statement.

I think I will collect the evidences and write the history to Cape Coral Police dept. then. I will sent them an e-mail and see what they will do.

My PI is a former police officer. He tried to have some help from his old colleges at the police department, but PI said that they all denied because they could not lift the evidences in souch cases.

Anyway, I will try your advise and drop Cape Coral Police Dept. an e-mail and see whats happens.

Well again, sorry to hear about this ordeal.

Couple of things though; why won't the police where he lives work with you? I know that if you were here it would be easier. For example, if you tell the police, "I want to make a written statement", then they have to accept that and they have to investigate your claims.

As for a reward for the delivery of the bike... a problem with that is that being in possession of the registration papers is not enough to establish or obtain legal ownership of the vehicle. Now, every state is different in regards to how they handle the transfer of vehicle ownership, but I know that many states require the owner to sign over a document under penalty of perjury to the new owner. The exception to this is if a court rules that you are the owner of the vehicle, and a new title is issued.
I know it's a bit confusing, but just understand that vehicles are regulated by state governments and there are stipulations and restrictions on the buying, selling, and transferring of ownership of a vehicle. If the seller is unwilling to transfer ownership on a titled bike, you'd likely need a court owner to legally own it.

So, there could be other ways that I don't know about, but I believe if someone just delivered the bike to you against the seller's will, you'd likely have a big problem on your hands there, even though it should rightfully be yours.

I could go to Florida. Just to have revenge it woulden´t burther me to travel to Florida just to have him judged. But eventhough as you says your self, he might not be able to pay or he will not pay.

How much will the IC3.com do to ? - will they set up a criminal court case and sent him to jail or is the case too smaal for this? Anyone have experiences with IC3 ?

Right now we are runing the case through (ebays?) SquareTrade.com he has claimed that he will cooperate. I am affraid SquareTrade overtalked him to do that. According to thier conditions they are in thier right to take my USD100 as soon as the other part replies.

Regarding setting up a homepage about the ebayerthatsuck, I am not sure if I dare hanging Mr. Lopez out.

In a e-mail i recived from him earlier he treadent me to sue me because I have hurt his feeling by sending a PI and accusing him for internet fraud.

Red flag #1. The seller states straight out that the will violate policy, and do a deal under the table regardless of the other circumstances. If he'll close it on a fair offer, he should have listed it as "buy it now" "or best offer".

"Serious buyers only – feel free to call (239-645-5415) or e-mail me with questions; include phone numbers."

Red flag #2. Posting his phone number means he is either an inexperienced seller, providing avenues to do business with off of ebay, or both.

"Total purchase price wire transferred within 3-days of auction close."

Red flag #3. Requesting wire transfer is a big no-no. Period.

Now, I know none of that helps you now, but it should help you in the future. As for getting your money back, being that the auction closed some 4 months ago, I wouldn't be surprised if they will not reverse the charges. Too much time has passed for that to happen now.

Your alternative is to file suit in a Florida court. The only problem is, you'd be required to show up in person, and being that you're in Europe, your cost to pursue this legally would be more than the value of the bike.
HOWEVER, if a court determines that the seller is at fault, he could be responsible for your costs to prosecute. The problem with that is, if the seller doesn't have the ability or even the willingness to pay, you would be out that money.

I'm sorry but looking at this it appears that you've lost that money. That seller, "edelta7" is a true ebayer that sucks. If I were you, I'd start up a website and put all of his information on it.

I made a so-called wire-transfer. My bank has claimed my money back from recievers bank. Meanwhile my money can only be returned if the reciever (seller) accepts it. (and I don´t think he will)

Another solutions could be selling my claim. In Denmark its quite normail that companies which has problems collecting thier money among costumers (or others) that owes them money to sell thier claim to a company which has specialized in collecting claims. If the claim will be hard to collect they may pay 10% of the original claim, if its easy to collect they may pay 90% of the claim. The claim companies use to be are quite good at collecting the money.

Is this kind of bussiness used in USA ? If so does anyohe have an adress of souch company in Florida.

You need to go to your bank, or financial institution, to have the charges reversed. I'm assuming that you wire transferred the money on an international order, which is a big no-no. If you used a credit card, do a chargeback. Otherwise, you're at the mercy of your bank, or whatever international fraud services your country offers.

What is critical here is getting your money back. That is dependent upon the payment method you utilized which has not been explained. Perhaps with this information I can help you further. I live in the US and can maybe offer some suggestions with a bit more information.

Forget about ebay helping. The seller is no longer registered and they do not care about what happened.

[center]I have lost USD9000 on item#130165782204 (Harley year 1993) I transfered the full amount and he should hand over the motorcycle to my shipping forewarder. After 4 weeks the bike was costum cleared to be shiped off. But the guy refues to hand over the bike to my shipping forewarder. The auction ended 24th. October 2007. I transfered the money October 30th. After discussing with the guy for 4 weeks and he still came up with excuses for not giving me the bike, I hired a private investigator. He found that the Harley was still in his garage. PI paid seller a visit but still he refused to hand over the bike. The PI stressed the seller for some days and at last seller got very agressive. PI dident think there was anything else to do but concider the money as lost.

Cape Coral Police dept. (where the guy lives) will not help. Ebay will not help. Danish Police ( I live in Denmark) will not help since the crime was commited in USA) I have repported the fraud to IC3 (but doubt this will help)

I have all evidence of fraude/scam on hand. I have a tracking of the transfered money and I have a e-mail where the guy claims that he will not hand over the motorcycle because there is a court order (by divorce) preventing him from selling the bike. Bullshit, the bike was put on auction in middle oct 2007 and the divorce case startet in June 2006, so the guy has been selling something that he was not allowed to sell.

My PI found that the guy has bad credit in several banks and at Ford Credit. Besides he is on his way to loose his house (dident pay tax or liens)

Does anyone have an idea what I can do ????
