The next day I get an email from the seller(Ken) saying that he was in Washington DC on business and would not be home for 4 days. He apologized for ending auction while he would be out of town and that he had the only keys to the lockbox or he would have had his wife ship diamond. &lt;P&gt;On Aug 9 I get an email from his wife(Gail) saying that Ken had been in a car accident on his way to the airport and that he was in the hospital with a broken leg. She was going to DC to check on him. &lt;/P&gt;&lt;P&gt;Aug 13 I get an email from Gail that lockbox keys had been overnighted to their 16 yr old son and that he would ship my diamond. I did receive a package on Aug 13 that was postmarked Aug 11. I was very excited to finally have my diamond but when I looked at it with my loupe it was scratched and the bottom point was chipped. Diamonds don't scratch. I took it to a local jeweler who tested it and told me that unfortunately it was not a diamond. &lt;/P&gt;&lt;P&gt;I emailed the seller and Gail responded that her son had gone to the wrong security box and had sent the wrong stone. She said she and Ken would be home Aug 14 and she would correct mistake. &lt;/P&gt;&lt;P&gt;On Aug 18 after hearing nothing for several days I get an email stating that after their investigation that they had sent a real diamond and that they were very upset that I would claim otherwise. I replied that the stone I received was not a diamond and that I would begin the remediation Process. I also called the phone # that eBay provided me. It was actually Ken's #. I left a message stating that he had not sent a real diamond. I left 3 phones for him to contact me at. &lt;/P&gt;&lt;P&gt;I got a text message from him requesting my email and I sent it to him. He sent me a email suggesting that I file a claim with the post office. He told me to state that the package was empty when I got it and say that it appeared the package had been tampered with. I replied that his only communications with me should be through the channel provided through PayPal remediaton. He replied that I had heard the last from him.      &lt;/P&gt;&lt;P&gt;I have escalated my Paypal dispute to a claim and also disputed the charge through VISA. VISA asked me to fax the emails to them which I did. Is there anything else I can do at this time? Can I file charges with any lawenforcement agency against this guy? He responded to my INR claim by sending a tracking number of a parcel shipped the day before, plus he has a delivered tracking number of the smaller package I received so I might not win an INR claim.  I don't think I can open a SNAD claim too, can I?  I'm really dissappointed at this seller. I am overseas however so I think maybe that was reflected somewhere on my ebay account by mistake (it wasn't).  So I email her and tell her I am overseas and mention communication before the fact would have been nice.  I get a nasty gram back from her telling me not to play the "support the troops" card because it is overplayed.  That having nothing to do with my intention, I am a little taken aback by her ignorance and blatant disrespect for those serving.  In my next correspondence I provide my paypal receipt with the stateside address listed as shipping address and tell her I find it disrespectful to downplay everything our troops are doing over here as "overplayed" and ask her to please see the receipt because there are no apo's on it.  I get another nasty response accusing me to get down off my soapbox and think I am better than her follwed by a childish poem about thinking before you speak. Please tell us EVERYTHING that you know. EVERYTHING. I want to be as well-informed as you are.&lt;br&gt;&lt;br&gt;I want the ins and the outs of it all. Describe every nut and bolt in detail.&lt;br&gt;&lt;br&gt;I work in marketing, soc. Perhaps 98-100% is an ideal set by ebayers--- and I think that eBay has a cut-off for point satisfaction rate of around 97%. That's for a reason which may be well beyond your comprehension. &lt;br&gt;&lt;br&gt;If I see a rating for a seller who has sold 100 items and he has five negatives, I am inclined to look at his sales as well as his feedback. I'll also look at the history of his buyers. Maybe he had the misfortune to BUY a dead laptop from someone who needed to unload it so that he could buy a new GameBoy. Wow. That's a 1% loss, but since I've looked into the history of that one feedback, I see that he was victimized. &lt;br&gt;&lt;br&gt;Suppose he has SOLD 99 new CDs. Two customers have a hissy fit (you know what I'm talking about, right, soc?) and complain that their CD arrived one day later than they expected. That's two hits which bring him down to 97%, which, by YOUR standard is atrocious. To me, that's still pretty good.&lt;br&gt;&lt;br&gt;Now, if the seller has 100 sales from 100 individual buyers, and his satisfaction rate is only 5%, I WOULD be worried about the seller. &lt;br&gt;&lt;br&gt;Let's take another example. We have a seller who has 10,000 sales of one type of product such as CF cards. He has a 99% approval. Maybe that's good, maybe it's not so good.That's telling me that the seller has a problem with his system, or his product has a very high rate of failure. When one looks at this particular product, one may find what seems to be a fixed rate of failure for that product. You a flip a coin or take the time to determine the nature of the complaints. Is it a complaint about shipping a CF card via FedEx from California to New York for five dollars, or is it  the same complaint of the seller shipping a refurbished CF card? If one percent of his complaints are about being sent refurbished CF cards, and his auction is NOT for a refurbished card, then suddenly that 99% doesn't look so good, especially in light of the fact that the card cost $2.00 and he sells it for $30.00. That's twenty-eight thousand dollars profit in the seller's pocket. That's a good example of a calculated risk. &lt;br&gt;&lt;br&gt;Then there are the sellers who will NOT allow one to bid  if he has left ANY neutral or negative feedback for any other seller. That seller has what appears to be a perfect track record. What the story doesn't tell is what it cost the seller to keep his buyer happy when something went wrong. (Things DO go wrong).  Say the seller sells Chinese-made goods at a huge mark up. Someone gets miffed because he received a set of ear buds that doesn't work. The seller is "honest" and does whatever he can to keep the negative FB off his record. He sends the buyer a whole set of ear buds to the buyer's family. &lt;br&gt;&lt;br&gt;Case closed. Nobody knows anything about the problem because the seller chose his buyers, people who probably don't leave feedback, or those who follow suggested protocol. They notify the buyer of the problem and then wait for a response. Perhaps some of the buyers just don't leave ANY feedback. Perhaps the select buyers just don't care. Whatever the case, the seller has picked his buyers in order to maintain an artificially high feedback rating, a rating which does not represent the norm. That's a smart move if one sells a product with a high rate of failure, or the seller deliberately sells refurbished CF cards to the unwitting.&lt;br&gt;&lt;br&gt;In the real world of marketing and selling, --- not the balloon-headed, delusional world of some nutcase garage sale eBay sellers---  one cannot always choose his buyer. Real world advertising is an attempt to do this. Price point is another. In the real world, one cannot refuse to sell to anyone who can pay.&lt;br&gt;&lt;br&gt;In the real world, one analyzes customer satisfaction by the numbers as well as by case. Then I noticed that this user had another listing for the same item and received negative feedback from another user because lodoss5000 never sent the item. This alarmed me and I contacted the 3rd party who I will call eagleM. Turns out eagleM had realized he was getting scammed because lodoss5000 never replied to any of his communique, so eagleM filed a dispute/claim with paypal and left negative feedback for lodoss5000. &lt;br&gt;&lt;br&gt;"!!DANGER!! The links I discovered to toolhaus.org and&lt;BR&gt;zug.com have really brightened my day.&lt;/P&gt;&lt;P&gt;Now, here's my problem: I purchased a cell phone which was&lt;BR&gt;represented to be "New, Never Opened."  What I received was a&lt;BR&gt;used phone with one of the accessories missing.&lt;/P&gt;&lt;P&gt;I e-mailed the seller but all I received in return was an offer&lt;BR&gt;to buy a warranty product called Square Trade.&lt;/P&gt;&lt;P&gt;I sent a second e-mail in which I offered to resolve the matter&lt;BR&gt;in one of three ways:&lt;/P&gt;&lt;P&gt;1.)  Exchange this phone for one that is, in fact, new and unopened&lt;/P&gt;&lt;P&gt;2.)  Return this phone for a full refund&lt;/P&gt;&lt;P&gt;3.)  Keep the phone and receive a partial refund based on what's&lt;BR&gt;     being offered on eBay at the present time&lt;/P&gt;&lt;P&gt;I don't know how I could be more fair than this.&lt;/P&gt;&lt;P&gt;Again all I received from the seller was another solicitation to&lt;BR&gt;spend $22.95 for a Square Trade warranty.  (The guy must be nuts&lt;BR&gt;to think I would make a second purchase after being defrauded the&lt;BR&gt;first time.)&lt;/P&gt;&lt;P&gt;Since I'm not experienced in the ways and means of eBay I thought&lt;BR&gt;I would ask the experienced users of this forum for advice along&lt;BR&gt;the following lines:&lt;/P&gt;&lt;P&gt;1.)  I thought perhaps I would send the seller a certified letter&lt;BR&gt;at this time so that I would have proof that he was contacted or&lt;BR&gt;that he refused to be contacted, depending on whether he accepted&lt;BR&gt;delivery or not. John has a listing up on ebay and he's selling a HP notebook computer. Larry (an acquaintance of John's) learns about the auction and tells John that he wants to buy it.&lt;br&gt;&lt;br&gt;John cancels the listing and Larry inspects the notebook, and it appears to be fully functional. Larry pays $350 and takes possession of the property.&lt;br&gt;&lt;br&gt;Two days later, John calls Larry and says that the notebook won't power on any longer and has stopped working. John tries to troubleshoot over the phone, but to no avail and offers to have Larry bring it by to work on it in person.&lt;br&gt;&lt;br&gt;Larry brings the notebook by and John verifies that it will not turn on. John points out that there is a burning smell and Larry says that he can smell nothing. John offers Larry the phone number for a couple of computer shops that can diagnose the problem and states that he has no idea what's wrong.&lt;br&gt;&lt;br&gt;Larry leaves, and later calls John, informing him that he had taken the notebook to the shop and for a $40 diagnostic fee, finds out that the motherboard is fried. They are well aware that Mac users on Safari browsers are having technical issues right now.  I went to leave a well deserved negative for a jerk of a buyer and there was feedback already left supposingly by me for a seller under this bidders buyers ID.  It's goofing up, leaving feedback for the wrong person when you click the button....it leaves it for the ID above or below the one you click on. When i contacted the buyer, he said that i paid for what i got and told me that he had mentioned in the description of the item that the card USED to have $500 in it and that it currently has no value. And well, he is correct, but that doesn't mean i'm not pissed off about this and want my money back. Is what this guy is doing illegal? would the law enforcements be able to do anything? all i know is that this guy lives in California, but i'm unsure if it'll even be worth my time to report this guy to the authorities. Fedex shows it delivered with a signature with the same last name as the buyer. I told the buyer this and she said she was home the morning of supposed delivery and nothing came, perhaps they accidently delivered to North King Street instead of South King Street and nothing like this has ever happened to her before.&lt;br&gt;&lt;br&gt;That's currently where I'm at with this. If she disputes with Paypal, I'm not protected. The signature makes me think I'm being scammed. I called Fedex and they are following up with the driver.   I am a powerseller and I know eBay is changing their terms allowing powersellers to ship to non-confirmed address and still be covered by their SPP, but I don't know if this is in effect or doesn't take hold until 2/20.&lt;br&gt;Any input?
